1. Scope of application

    a) The Terms of Use apply to all registered users for all pages and services provided on SneakerBase.de.

    b) The Terms of Use are available on the Internet at any time and can be printed out. They apply to all free and fee-based (see SneakerBase HD) one-off or subscription services.

    Any terms and conditions of the user that conflict with or deviate from these Terms of Use shall not apply.

    c) SneakerBase reserves the right to amend these Terms of Use at any time. SneakerBase is obliged to inform every user of the website of changes to the terms of use by e-mail or private message. Changes to the terms of use will be announced at least 1 month in advance. After notification of the changes and the set deadline, at least one month after notification, the new terms of use must be approved by each individual user. Rejection will result in the deletion of the user profile.

    d) In case of doubt regarding the rules listed here, the final decision lies with the administrators/moderators. These must be respected and followed.

  2. Usage

    In accordance with these Terms of Use, SneakerBase grants the user a non-exclusive, non-transferable and limited right to access and use SneakerBase.de. This is exclusively for personal and non-commercial purposes.

    1. Netiquette

      The following points regulate the interaction with other users on SneakerBase.de and apply in particular to the forum, in the chat, in deals or in comments on collection items or users.
      • The general tone should be polite and courteous towards other users, even if it is sometimes difficult to remain friendly. A topic often only becomes interesting when everyone has been able to express their opinion without being insulted.
      • Users undertake to comply with applicable law and morality. In particular, it is undesirable:
        • publish content that is offensive, racist, discriminatory, incites violence or is untrue.
        • post sexual content in areas that are accessible without age restrictions.
        • post content in any form that is obviously aimed at persons under the age of 16.
        • publishing private information of third parties whose consent has not been obtained
        • disrupt the system with spam (advertising for other sneaker sites or forums is only allowed in the signature).
        • publish third-party content without citing the source and obtaining their express consent.
        • Repost answers and content that already appear in previous posts (use the search function).
        • to use so-called reflinks, affiliate links or advertising links.
        • Post contact information in publicly viewable areas.
        • Use messages to push a topic with missing or nonsensical content.
        • Titles that say little or nothing, such as "Need help!!!!!!!!!!!" or "Hey"

      If the above rules are violated, the administrator/moderator can take the following measures:
      • Deletion, modification or merging of content posted by the user,
      • Issuance of a warning or
      • Blocking access to the forum, chat or the entire site.

  3. User account

    The following provisions govern the use of your account on SneakerBase.de

    1. Creating a user account

      Anyone who has reached the minimum age of 16 years can create a user account on SneakerBase free of charge and use all functions of the site. In accordance with netiquette, however, duplicate accounts, fake accounts or other types that violate netiquette are excluded and will be punished with the above-mentioned measures.

      The user account created is personal and may only be used by oneself. The use of a user account by several users is not permitted. It is permitted to display the profile as a group of people.

    2. Deletion of the user account

      a) It is possible to delete your profile on SneakerBase.de at any time and without giving reasons. The option for deletion can be found on the user account management page.
      Exception: If there are active deals, these must first be completed before the profile can be deleted

      The user account will be marked for deletion for 1 week. During this time, it is possible to cancel the deletion process on the above-mentioned page. After the deletion period has expired, the user account and all content, with the exception of the exceptions mentioned under b), will be deleted.

      b) Content not removed when the user account is deleted
      By using SneakerBase.de, links are created at many points with functions of the website that are important for other users. In order to provide a smooth service, some user-created content will not be removed. Of the content listed below, all but the data mentioned will be removed.
      • Sneaks/Socks/Sportswear/Accessories that have been successfully traded: Characteristics and the 1st picture in standard resolution
      • Deals: All deal data until the deal partner's user account is also deleted
      • Private messages: All private messages until the user account of the respective conversation partner is also deleted or the conversation partner deletes the conversation
      • Chat messages: Chat messages are automatically deleted after 7 days
      • Forum posts: Link to deleted user profile will be removed.

  4. User-created content

    The following provisions govern the creation, use and distribution of user-created content.

    1. Media

      Wherever media (pictures, videos, audio) can be uploaded to SneakerBase.de, the following guidelines must be observed:
      • Media with offensive, racist, discriminatory, violent or untrue content are prohibited.
      • You are the author of the mediaor have the author's written consent for publication (please specify in the description or the title of the medai)
      • Visual media that obviously depict persons under the age of 16 are prohibited.
      All media in the Discover/Collection and Fake Checks sections are checked for their content and either activated for all users to see, deleted or marked as FSK18 (which means that only users who have proven their age can experience the media)

      In all other areas (e.g. profile incl. avatar, forum) only media rated E (Everyone) are permitted. Ao (Adults only) rated media will be deleted.

    2. Collection (Sneaks, Socks, Sportswear, Accessories)

      In order for your collection to be found, categorized correctly and to work for deals, the following guidelines must be observed.
      • When you add something to your collection, all fields must be able to be filled in truthfully. This excludes the following:
        • Several different items in one entry. It must be clear from the images which specific item is involved. The characteristics must match.
        • Multiple entries for the same item (deals would no longer work)
          If you have several identical items, please upload a photo of the label with each entry.
      • Counterfeit products, so-called fakes, are undesirable and will be deleted. If there is any doubt about the authenticity of the product, the user may be asked to upload additional images to prove its authenticity. A renewed upload is considered a repeated breach of the rules. Images of counterfeit products may be used in the forum for the purpose of warnings/illustration.
      • In addition to the guidelines mentioned under "Media", the following applies:
        • All media have the subject of the entry as their theme
        • In the first picture, the subject of the entry must be clearly in the foreground.

        Media that do not comply with these rules belong in an album. The administrator/moderator can take the following measures if the above guidelines are violated:
        • Reorder images
        • Delete item
        • Move item into another category
        • Disable item (for the user to correct any issues)
        • Issuing a warning and, if necessary, temporarily blocking the user account

    3. Collection (Album)

      The albums offer a place for all pictures/videos that are not covered by one of the other categories or are excluded by the guidelines mentioned under "Collection (Sneaks/Socks/Sportswear/Accessories)".
      The guidelines listed under "Media" apply.

    4. Deals

      With the deal system, SneakerBase offers a comprehensive and convenient way to buy/exchange/rent sneakers/socks/sportswear/accessories. The system is based on mutual trust and honesty. To ensure the smooth running of a deal, all relevant information should be shared in the deal. Communication via other channels, including those provided by SneakerBase, can lead to misunderstandings or lost information in case of doubt.


      The following rules apply to the activation of deals:

      • The items are in the possession of the author or the author has the consent of the actual owner to sell the items. In case of doubt, proof may be requested.
      • The condition must be current in the pictures or made clear at the beginning of the deal, otherwise it can be considered an attempt to deceive.
      • Fraudulent intentions lead to exclusion from the deal system or the entire site.


      Cancellations
      If deals are not concluded as expected, deals can be canceled. If no material damage has occurred, the deal partner must agree for the deal to be canceled. In the event of material damage, the termination will be assessed and decided by the moderation team. All decisive information must be available in the course of the deal in order to be able to approve the cancellation. Missing information can be submitted later, provided it is comprehensible.


      Disclosure of data
      In the event that a deal is reported and the police requests information from SneakerBase, all relevant information pertinent to the investigation will be disclosed. Such information includes (but is not limited to): Name, address, IP and email addresses.

  5. Chat

    The chat is intended as a virtual meeting place for sharing information. To ensure that this works as well as in real life, a few rules must be observed. In principle, the terms of use and in particular the SneakerBase netiquette apply. The following explanations also apply:
    • Basically, all the rules that ensure pleasant interaction also apply in the chat. Behave in a friendly and polite manner and do not exclude anyone. Even if there are sometimes heated discussions in the chat and you may come under fire yourself, you should always remain calm, correct and objective. Personal attacks, insults, threats or other aggressive behavior should be avoided. Private disagreements should also be dealt with privately, not in the Main or at the expense of others. Harassment via private messages can be stopped by blocking the user.
    • The moderators will intervene if they are convinced that this is necessary. Not to be tolerated:
      • Bullying
      • Continuous provocations and/or insults (whether subtle or direct)
      • Private disputes
      • Spam, be it advertising or posting the same sneakers, pictures, videos over and over again
      • Publishing any content that violates the rights of third parties (third-party images, private messages, etc.)
      • Constant aggressive writing in CAPITAL LETTERS or with many repeated punctuation marks (!!!!!!, ??????, etc.)
    • Provocations do not give you the right to "vigilante justice". This can lead to moderators no longer intervening or intervening on both sides.
    • Even if a more relaxed tone is allowed in the chat, you should still pay attention to your specific choice of words.
    • The moderation team can exclude chat participants from the chat immediately or at a later date. This is initially done temporarily, and in individual and repeated cases permanently if necessary.
    • Bypassing the chat lock by technical means is a violation of the terms of use and may lead to further restrictions or to the closure of the main account (temporarily or permanently).

  6. SneakerBase HD

    With SneakerBase HD you support the development of SneakerBase and receive various benefits as a thank you. The benefits can be changed, extended or removed at any time.


    Refunds

    If the user account is temporarily blocked, SneakerBase HD can either be extended for the duration of the block or refunded pro rata for the duration of the block. If the user account is permanently blocked or the site is terminated, SneakerBase HD will be refunded on a pro rata basis.


    Time-unlimited packages, e.g. "Sneaks 4 Life" and "AgeCheck", are excluded from a refund.

  7. Limitation of liability

    1. Own content

      All contents of our website have been created with care and to the best of our knowledge. However, no guarantee can be given for the topicality, completeness and correctness of all pages.

      In accordance with Section 7 (1) TMG, we are responsible as a service provider for our own content on these pages in accordance with the general laws, but in accordance with Sections 8 to 10 TMG we are not obliged to monitor the transmitted or stored third-party information. This content will be removed immediately from the time we become aware of a specific infringement and we are not liable before the time we become aware of it.

    2. External links

      Our website contains so-called "external links" (links to third-party websites) over whose content we have no influence and for which we therefore accept no liability. The respective information provider of the linked websites is responsible for the content and accuracy of the information. When the links were created, we were not aware of any legal violations.
